Liability Waiver & Release of Claims
ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT
PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING AGREEMENT
By signing this document or participating in any Dirt Craft MTB activities, you acknowledge and agree to the following terms:
1. ACKNOWLEDGMENT OF RISK
I understand and acknowledge that mountain biking is an inherently dangerous sport that involves risks of serious injury, permanent disability, paralysis, and even death. Risks include, but are not limited to:
- Falls, crashes, and collisions with objects, other riders, or natural terrain
- Equipment failure, including but not limited to bikes, helmets, and protective gear
- Exposure to harsh environmental conditions such as heat, cold, wind, rain, or wildlife encounters
- Terrain hazards, including loose rocks, roots, drop-offs, jumps, and other unpredictable obstacles
- My own physical condition, medical limitations, and ability to participate safely
I acknowledge that these risks are a natural part of the sport and that Dirt Craft MTB cannot eliminate them.
2. RELEASE OF LIABILITY & WAIVER OF CLAIMS
To the fullest extent permitted by law, I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby voluntarily waive, release, and discharge Dirt Craft MTB, its owners, officers, employees, instructors, agents, representatives, volunteers, and affiliates (collectively, “Released Parties”) from any and all liability, claims, demands, actions, or causes of action for injuries, damages, or losses, including but not limited to those resulting from:
- Personal injury, illness, disability, or death
- Property damage or loss
- Negligence (except gross negligence) of the Released Parties
I understand that this waiver includes, but is not limited to, any claims arising from ordinary negligence, improper instruction, failure to warn, unsafe conditions, or lack of protective gear.
3. ASSUMPTION OF RESPONSIBILITY
I accept full responsibility for:
- My own safety and actions while participating in any Dirt Craft MTB activity
- Ensuring my bike and gear are in safe working condition
- Wearing appropriate protective equipment, including but not limited to a helmet
- Following all instructions given by Dirt Craft MTB instructors and adhering to safety guidelines
I understand that my failure to follow safety recommendations may increase my risk of injury or harm.
4. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless Dirt Craft MTB and all Released Parties from any claims, damages, legal fees, or liabilities arising out of my participation, whether caused by my own actions, the actions of others, or any conditions of the course or environment.
5. MEDICAL TREATMENT & INSURANCE
I understand that Dirt Craft MTB does not provide medical coverage or insurance. I certify that I have adequate medical insurance or the means to cover medical expenses in case of injury. I also authorize Dirt Craft MTB to obtain emergency medical treatment on my behalf if needed, understanding that I am financially responsible for any associated costs.
6. LEGAL AGREEMENT & SEVERABILITY
I understand that this agreement is legally binding and applies to all present and future participation in Dirt Craft MTB activities. If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
7. PARTICIPANT'S CERTIFICATION
I acknowledge that I have read and understood this agreement. I am voluntarily signing this release and assume all risks associated with mountain biking. I understand that by signing this document, I am giving up legal rights, including the right to sue Dirt Craft MTB or seek compensation for injuries.
